Terms of carriage
Carriage conditions of the Prešporok TAXI Bratislava taxi service. They form part of every passenger contract. The binding version is the Slovak one.
1. Introductory provisions
- The carrier holds a concession authorising it to carry passengers under a contract of carriage.
- These terms set out the carrier's conditions for contracts of carriage in taxi service.
- The published terms are part of the carrier's offer and, once a contract is concluded, become part of its content.
- The terms take effect on publication and form part of every contract of carriage.
- By booking a ride, the passenger confirms having read the contract and these terms.
2. Duties of the carrier
- Operate the taxi service in accordance with these terms.
- Charge according to the current price list and issue a receipt on request.
- Ensure safe, comfortable and calm transport of passengers and their luggage.
- Mark operated vehicles with the carrier's trade name.
3. Taxi vehicle
- Is listed in the concession and has an assigned taxi vehicle number visible to passengers.
- Shows the carrier's trade name and the dispatch or carrier phone number on the front left and right doors.
- Has a working built-in taximeter showing the current fare and issuing a receipt (not required when the fare is paid before the ride).
- Displays the base fare on the front right door and inside the vehicle (not required for prepaid rides).
- Is insured against liability for injury to passengers or damage to their property.
- Has a yellow illuminated TAXI sign on the roof.
4. Taxi service
- The driver takes the shortest route the traffic allows unless agreed otherwise or the passenger requests another route.
- Smoking, drinking, eating and feeding animals in the vehicle are prohibited. A front-seat passenger must not obstruct the driver's view.
- The driver decides whether luggage travels as hand luggage in the passenger area or in the boot.
- Passengers must point out luggage that needs special handling, especially its contents and value.
- The driver loads and unloads luggage; the passenger helps on request.
- The driver may check luggage in the passenger's presence. Excluded items must be removed, otherwise the passenger may be excluded from the ride.
- Excluded are items banned by law, loaded weapons (except armed forces and police), items that could endanger or soil the vehicle or passengers, and items with an offensive smell or appearance.
- The number of passengers must not exceed the seats stated in the vehicle registration.
- Only persons permitted by traffic rules may sit in the front seat.
- On request the driver issues a receipt with document number, vehicle number, date, pick-up and drop-off points, fare paid and driver's signature.
- The driver carries the vehicle registration, technical and emission inspection certificates, insurance proof, a copy of the concession, the taximeter verification (if required) and a visible taxi driver card.
5. Contract of carriage
- The contract is concluded under Sections 760 to 764 of the Slovak Civil Code.
- It can be concluded at a taxi stand, anywhere in the concession area, at the carrier's premises, via the mobile app or via dispatch.
- Before the ride the passenger may review the current price list.
- By concluding the contract the carrier undertakes to take the passenger to the destination on time. The driver may refuse the ride if these terms are not met.
- By boarding, the passenger undertakes to pay the fare. Refusal to pay may be enforced in court.
6. Withdrawal from the contract
- The carrier may withdraw if the passenger does not comply with the contract or these terms.
- The driver may refuse or stop a ride if road conditions, weather or an accident make it technically or safely impossible; if the passenger smokes, eats or drinks despite a warning, breaches safety, threatens the driver or soils the vehicle; if the passenger's behaviour, destination, route or other circumstances threaten health, safety or the vehicle; if the passenger's condition risks soiling the vehicle or harassing the driver; if luggage cannot be carried at once due to its quantity, size, weight or shape; or if animals cannot be carried safely.
- The passenger may withdraw if the carrier or driver breaches the contract or these terms.
7. Lost property
- The driver must return found items to their owner.
- If the owner is unknown or does not collect the item on the day it is found, the driver hands it over to the carrier.
- The item is released to whoever credibly proves ownership.
